1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of khotan.com and the information, forms, and other materials available through it (together, the "Website"). By using the Website, you agree to these Terms.

If you use the Website for a company or another organisation, you confirm that you have authority to accept these Terms on its behalf. In that case, "you" includes that organisation.

2. Customer agreements

Khotan provides customer projects and services under separate written agreements, such as an order form or master services agreement. If a written agreement applies to your use of a Khotan service, that agreement controls if it conflicts with these Terms.

The Website describes Khotan at a general level. Website content is not a service commitment, warranty, specification, or part of a customer agreement unless that agreement says otherwise.

3. Using the Website

Khotan gives you a limited, revocable, non-exclusive, non-transferable right to use the Website for lawful business evaluation and communication with us. You must comply with applicable law and these Terms.

You are responsible for the accuracy of information you submit and for having the right to provide it. Do not submit confidential, regulated, or sensitive information through a public Website form unless Khotan specifically asks for it and appropriate protections are in place.

4. Acceptable use

You must not, and must not help anyone else to:

• Use the Website to break the law, infringe another person's rights, or distribute unlawful, harmful, or deceptive material.

For a Khotan service governed by a separate written agreement, the liability terms in that agreement apply. Nothing in these Terms limits liability that cannot lawfully be limited.

11. Suspension and termination

We may restrict or end your access to the Website if you breach these Terms, create risk or harm, or if we discontinue the Website. You may stop using the Website at any time. Provisions that by their nature should continue after termination will continue, including those concerning intellectual property, disclaimers, and liability.

12. Changes to these Terms

We may update these Terms. We will post the revised Terms here and update the date above. Changes apply when posted unless we state otherwise. Your continued use of the Website after a change means you accept the revised Terms.

13. General terms

If a provision of these Terms is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and Khotan about the Website. They do not replace any separate written customer agreement.
